• एक तो यह आप जिस property के title धारी है यानि वह property आपके नाम है |
• दूसरा आप property के title धारी नहीं है यानि property आपके नाम पर नहीं है | 

इसके लिए हमारे कानून में एक एक्ट बनाया गया था Specific Relief Act, Specific Relief Act

का section 5 और section 6 इसके समाधान की बात करता है |  

अगर property आपके नाम है और आप property के टाइटल धारक है और किसी ने कब्ज़ा कर लिया है तो ऐसे में आपको  Specific Relief Act के Section 5 के तहत केस को दर्ज करना होगा | जिसका procedure, Civil Procedure court (CPC) में बता दिया गया है | Court में केस करने के बाद सबसे पहले आपको स्टे लेना होता है | कही ऐसा न हो जिसने आपकी property पर कब्ज़ा किया हुआ है वहा पर कोई बिल्डिंग या फिर निर्माण कार्य न शुरू करवा दे या फिर किसी अन्य व्यक्ति को बेच दे | इस तरह केर मामले court में काफी लम्बे समय तक चलते है जैसे कि 5 साल, 10 साल या तक की 20  साल तक Civil Case चलते है | 

अगर आपकी property आपके नाम पर नहीं है और कोई कब्ज़ा कर लेता है तो आप Specific Relief Act के Section 6 के तहत केस को दर्ज करना होगा | लेकिन इसमें कुछ शर्ते है :

कोर्ट जो भी फैसला देंगी आप अपील और रिव्यु नहीं करा सकते है | इसमें जो कोर्ट फैसला देंगी उसी को आपको मानना होगा आप High Court और Supreme Court में अपील नहीं कर सकते है | (NO Appeal, No Review After judgement of Court)

आपको 6 महीने के भीतर केस को दर्ज करना होगा | (File Case in 6 Months)
